Domicile
- Domicilium est ubi quis degit rerumque suarum summam constituit eo consilio ut ibi maneat. A domicile is where one spends time and where one places the greater part of his personal effects with the aim of staying there.
- Domicilium re et facto transfertur, non nuda contestatione. A domicile is changed in substance and by action, not by mere assertion. Dig. 50.1.20.
- Eam domum unicuique nostrum debere existimari, ubi quisque sedes et tabulas haberet suarumque rerum constitutionem fecisset. (It is decided that) for each of us it should be considered his home where each has his residence and records and has set up the management of his affairs. Dig. 50.16.203.
- Incolas domicilium facit. Literally, the domicile makes the residents. • That is, the principal place of residence establishes legal residency. Often rendered conversely, Incola domicilium facit (residence creates domicile).
- Nihil est impedimento quominus quis ubi velit habeat domicilium quod ei interdictum non sit. Nothing bars somebody from having a domicile where he wants, if it is not (specifically) prohibited to him. Dig. 50.1.31 (regarding the rights of townsmen and foreign residents).
- Sola domus possessio quae in aliena civitate comparatur domicilium non facit. The mere possession of a house that is bought in another city does not make it a domicile. Dig. 50.1.17.13.
- Vagabundum nuncupamus eum qui nullibi domicilium contraxit habitationis. We call the person a vagabond who has acquired nowhere a domicile of residence.
